Please read these Terms of Service carefully before purchasing, accessing, or using any of our Programs, Products, or Services.

These Terms require the use of arbitration on an individual basis to resolve disputes, rather than jury trials, and limit the remedies available to you in the event of a dispute. By enrolling in, purchasing, or using our Programs, Products, Services, or related materials, you are waiving certain legal rights voluntarily.

By purchasing or using any of our Programs, Products, or Services, you agree to act in accordance with these Terms, as well as our Privacy Policy and Refund Policy. You confirm that you are at least 18 years of age.

Free Trials and Wallet Credits

OptimizeONE may offer free trials from time to time. A valid payment method is required to initiate the trial. If the subscription is cancelled before the trial period ends, no charges will be applied. If the subscription is not cancelled before the trial ends, the payment method provided will automatically be charged for the selected subscription term (monthly or yearly).

During the trial period, users receive a $10 wallet credit to test the system. If usage exceeds the provided wallet credit, users will be charged for the excess usage. Charges may include, but are not limited to, email campaigns, SMS messages, phone number purchases, phone calls, or AI-related services.

Wallet Balances will be automatically topped off based on user defined low levels.

Intellectual Property Rights

All content provided in our Programs, Products, and Services, including but not limited to design, layout, graphics, and materials, is our property or licensed to us. You are granted a limited, revocable, non-transferable license for personal use only. Unauthorized use, reproduction, or sharing of content is strictly prohibited.

Confidentiality and Privacy

We respect your privacy and strive to keep your personal information confidential and secure. For more details, refer to our Privacy Policy.

Purchases and Payments

By purchasing our Programs, Products, or Services, you authorize us to charge your payment method for the agreed amount. If payments are not completed on time, access to the purchased materials may be suspended. Payment defaults may be sent to collections, potentially impacting your credit.

Limitation of Liability

Termination

We reserve the right to terminate access to our Programs, Products, or Services at any time for violations of these Terms. Upon termination, any remaining balances must be paid within 24 hours.

Dispute Resolution

All disputes must be resolved through binding arbitration in accordance with the American Arbitration Association Rules. Arbitration will take place in Denville, NJ.
